Sheriff Officers

Sheriff Officers are Officers of Court who are commissioned by the Sheriff Principal to carry out duties in relation to the service of court documents and the enforcement of court orders. Officers have to undergo a three year training period and have to pass professional examinattions before obtaining a commission from the Sheriff Principal. They are responsible for enforcing orders of the Sheriff Courts and various other courts and tribunals. All Sheriff Officers are members of the Society of Messengers-at-Arms & Sheriff Officers.

Messenger-at-Arms

Messenger-at-Arms is an experienced Sheriff Officer who has obtained a further qualification and in this case a commission from the Lord Lyon King of Arms. They are responsible for enforcing orders of the Court of Session and other supreme courts.

Charge for Payment

Charge for Payment is a formal written demand for payment served by an Officer by virtue of a court decree or decision. The Charge allows the debtor usually 14 days to pay the debt. A Charge is a necessary pre-requisite to certain Diligences.

Arrestment

Arrestment is a Diligence which is served on third parties who may hold funds or property belonging to a debtor. The Arrestment freezes the funds in the hands of the third party until (in the case of funds) the automatic release period of 14 weeks is reached at which point the funds are released to the creditor. The most common third parties are banks and building societies.

Earnings Arrestment

Earnings Arrestment can only be executed following service of a Charge for Payment. This is served on a debtor's employer and has the effect of requiring the employer to make a deduction from the debtor's salary every payday until the debt is paid.

Inhibiton

This is an order served by an Officer which prevents a debtor selling, burdening or otherwise disposing of their heritable property.

Attachment

Charge for Payment is required beforehand and this is a Diligence used to attach moveable property e.g a car in a debtor's possesion. An Attachment is followed by an Auction of the attached articles where the matter has not been resolved.

Exceptional Attachment

This is the form of Attachment used in relation to goods in a domestic address. A further application is required in order to obtain an Exceptional Attachment Order.

Money Attachment

This is the form of Attachment used to attach money in commercial premises. A Charge for Payment must be served before attempting a Money Attachment.
