This is Fraser Irvine Sheriff Officers LLP’s privacy notice (also known as a Fair Processing Notice). We are committed as an organisation to protecting and respecting your privacy. This privacy notice describes the ways in which we collect, manage, process, store and share information about you and your rights regarding it.

For the purposes of this notice if we refer to “we”, “us”, or “our” we are referring to Fraser Irvine Sheriff Officers LLP.

Our lawful basis for processing your information

The General Data Protection Regulation (GDPR) requires all organisations that process personal data to have a Lawful Basis for doing so. The Lawful Basis identified in the GDPR are:

  • Consent of the data subject
  • Performance of a contract with the data subject or to take steps to enter into a contract
  • Compliance with a legal obligation
  • To protect the vital interests of a data subject or another person
  • Performance of a task carried out in the public interest or in the exercise of official authority vested in the controller
  • The legitimate interests of ourselves, or a third party, except where such interests are overridden by the interests, rights or freedoms of the data subject.

Our lawful basis for processing data are Legal Obligations, Official Authority and Legitimate Interests.

What information do we obtain, process and/or store

We receive basic personal information relating to both pursuers/creditors and defenders/debtors from our clients and other statutory authorities when instructions are issued to us in exercise of our Official and Extra-Official functions as Sheriff Officers and Messengers-at-Arms. This includes the service of legal documents (Citation), the enforcement of court judgments and decrees (Diligence) and debt recovery.

The personal information which is obtained consists of name, addresses, and details of the decree, warrant or order made by the court and in certain instances bank or employment details. We also may obtain telephone numbers and email addresses.

Occasionally we will be provided with information concerning potential vulnerability, generally by the data subject, or by persons or agencies acting on his or her behalf.

We also collect data in fulfilment of our role as an employer.

We use your information to

Enable us to carry our Official and Extra-Official functions including the service of legal documents (Citation), the enforcement of court judgments and decrees (Diligence) and debt recovery

Carry out our role as an employer

Make statutory returns as required by HMRC

Make any reports to Courts or other statutory organisations as required by legislation

Investigate and address your concerns

Who do we share information with

We may share your information with our instructing clients and their agents, our sub-contractors and law enforcement officials, government authorities, or other third parties where we have a legal obligation or legitimate interest to do so. In dealing with or responding to a complaint we may also share you information with the Society of Messengers-at-Arms & Sheriff Officers and other regulatory bodies including Sheriff Principals, Scottish Court Service, Scottish Courts, Credit Services Association and the Financial Conduct Authority.

How long the data will be kept

We will only retain your personal data for as long as is necessary to fulfil the purposes we collected it for or to comply with legislation or industry compliance guidance. Our Retention and Destruction Policy (copy available on request) details how long we hold data for and how we dispose of it when it no longer needs to be held.

International transfer

The majority of your information is processed in the UK and EEA (European Economic Area). We will only transfer data outwith the UK and EEA when complying with an instruction for service or enforcement of court orders in another State and in those instances only to competent bodies as defined by the Hague Convention or similar international and bi-lateral agreements.

Accessing your information

You have the right to ask us for a copy of any personal data that we hold about you. This is known as a “Subject Access Request”. Except in exceptional circumstances (which we would discuss and agree with you in advance), you can obtain this information at no cost. We will send you a copy of the information within 30 days of your request.

Correction of personal information

If you believe that any of the information we hold about you is incorrect or incomplete please contact us as soon as possible using the details provided in the “How to contact us” section of this notice. We will promptly correct or remove any information that is incorrect.
